managements of all the condominium regarding the mandatory periodical building inspection.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size: large;"&gt;According to the law,&lt;span style="color: red;"&gt;ACT 903A and ACT 133&lt;/span&gt;,condominium of &lt;span style="color: red;"&gt;above five storey high&lt;/span&gt; and have obtained &lt;span style="color: red;"&gt;certificate of fitness (CF) for more than ten years&lt;/span&gt; must be inspected by a qualified professional structural engineer.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size: large;"&gt;The letter comprises a cover page and some forms.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size: large;"&gt;In the cover page,the condominium management is instructed to appoint a civil and structural engineer,within 60days, to carry out inspections on the structural integrity of the condo buildings as well as other common areas.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size: large;"&gt;Subsequently,Engineer's Reports must be submitted to the local authorities within 14 days.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size: large;"&gt;There are four forms attached in the letter,i.e.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-size: large;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-size: large;"&gt;1.Appointed Engineer's particulars&lt;/span&gt;&lt;br /&gt;&lt;span style="font-size: large;"&gt;2.Engineer's declaration on the findings of his inspection (no rectification works recommended)&lt;/span&gt;&lt;br /&gt;&lt;span style="font-size: large;"&gt;3.Engineer's declaration on the findings of his inspection ( rectification works style="font-size: large;"&gt;Pemeriksaan bangunan secara berkala&lt;/span&gt;&lt;br /&gt;The letter received by condo management from local authorities, for condominium building inspection by professional engineers, quoted the ACT 903 ,Section 85A .&lt;br /&gt;&lt;br /&gt;Below is the excerpt of the ACT903.85A&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size: x-large;"&gt;&lt;/span&gt;&lt;br /&gt;85A.&lt;br /&gt;(1) Dalam seksyen ini—&lt;br /&gt;“jurutera” ertinya seorang jurutera profesional yang berdaftar di&lt;br /&gt;bawah Akta Pendaftaran Jurutera 1967;&lt;br /&gt;“pemunya” ertinya pemunya sesuatu bangunan dan berhubungan&lt;br /&gt;dengan bangunan yang dipecahbahagikan termasuklah pemunya&lt;br /&gt;petak bangunan itu.&lt;br /&gt;*CATATAN—Dahulu “satu ribu ringgit” dan “satu ratus ringgit”–lihat Akta Jalan, Parit dan Bangunan&lt;br /&gt;(Pindaan) 1994 [Akta A903].&lt;br /&gt;Jalan, Parit dan Bangunan 111&lt;br /&gt;(2) Seksyen ini hendaklah terpakai hanya bagi sesuatu &lt;span style="color: red;"&gt;bangunan&lt;/span&gt;&lt;br /&gt;&lt;span style="color: red;"&gt;yang melebihi lima tingkat &lt;/span&gt;dan mana-mana tingkat sesuatu bangunan&lt;br /&gt;yang adalah atau terletak di paras yang lebih rendah daripada&lt;br /&gt;tingkat bawahnya hendaklah disifatkan sebagai suatu tingkat.&lt;br /&gt;(3) Pihak berkuasa tempatan boleh, tanpa menjejaskan kuasanya&lt;br /&gt;di bawah seksyen 83, melalui notis secara bertulis yang disampaikan&lt;br /&gt;kepada pemunya sesuatu bangunan, menghendaki bangunan itu&lt;br /&gt;diperiksa—&lt;br /&gt;(a) &lt;span style="color: red;"&gt;selepas tahun kesepuluh yang bermula dari tarikh perakuan&lt;/span&gt;&lt;br /&gt;&lt;span style="color: red;"&gt;kelayakan menduduki &lt;/span&gt;yang pertama berkenaan dengan&lt;br /&gt;bangunan itu dikeluarkan; dan&lt;br /&gt;(b) selepas daripada itu pada lat tempoh yang tidak lebih&lt;br /&gt;daripada sepuluh tahun dari tarikh penyempurnaan&lt;br /&gt;pemeriksaan yang terakhir bangunan itu di bawah seksyen&lt;br /&gt;ini.&lt;br /&gt;(4) Pemunya sesuatu bangunan hendaklah, apabila menerima&lt;br /&gt;suatu notis di bawah subseksyen (3), menyebabkan bangunan itu&lt;br /&gt;diperiksa dalam masa yang ditetapkan dalam notis itu oleh seorang&lt;br /&gt;jurutera yang kena dilantik olehnya.&lt;br /&gt;(5) Jika notis di bawah subseksyen (3) tidak dipatuhi, pihak&lt;br /&gt;berkuasa tempatan boleh memeriksa bangunan itu atau menyebabkan&lt;br /&gt;bangunan itu diperiksa oleh seorang jurutera yang dilantik olehnya&lt;br /&gt;dan mendapatkan segala perbelanjaan yang dilakukan secara&lt;br /&gt;munasabah olehnya pada berbuat sedemikian daripada pemunya&lt;br /&gt;bangunan itu.&lt;br /&gt;(6) Seseorang jurutera yang melakukan suatu pemeriksaan di&lt;br /&gt;bawah seksyen ini hendaklah memeriksa bangunan itu mengikut&lt;br /&gt;cara yang ditetapkan dalam undang-undang kecil yang hendaklah&lt;br /&gt;mengambil kira yang berikut:&lt;br /&gt;(a) s&lt;span style="color: red;"&gt;uatu pemeriksaan visual bangunan&lt;/span&gt; itu, termasuklah&lt;br /&gt;tinjauan visual tentang keadaan bangunan dan unsur&lt;br /&gt;strukturnya dan apa-apa tambahan atau pengubahan pada&lt;br /&gt;bangunan itu dan unsur strukturnya;&lt;br /&gt;(b) penyediaan dan pengemukaan kepada pihak berkuasa&lt;br /&gt;tempatan suatu laporan tentang hasil pemeriksaan visual&lt;br /&gt;itu;&lt;br /&gt;(c) jika, selepas menimbangkan hasil pemeriksaan visual itu,&lt;br /&gt;jurutera itu &lt;span style="color: red;"&gt;mengesyaki secara munasabah atau berpendapat&lt;/span&gt;&lt;br /&gt;&lt;div style="color: red;"&gt;112 Undang-Undang Malaysia AKTA 133&lt;/div&gt;&lt;span style="color: red;"&gt;bahawa ada kecacatan&lt;/span&gt;, perubahan bentuk atau kemerosotan&lt;br /&gt;pada bangunan itu atau unsur strukturnya yang akan atau&lt;br /&gt;mungkin akan membahayakan atau mengurangkan&lt;br /&gt;kestabilan atau keutuhan struktur mana-mana bahagian&lt;br /&gt;bangunan itu, dia hendaklah meminta kebenaran daripada&lt;br /&gt;pihak berkuasa tempatan untuk melakukan suatu siasatan&lt;br /&gt;struktur sepenuhnya ke atas bangunan itu termasuklah&lt;br /&gt;siasatan berkenaan dengan unsur strukturnya;&lt;br /&gt;(d) jika pihak berkuasa tempatan membenarkan permintaan&lt;br /&gt;yang dibuat di bawah perenggan (c) jurutera itu hendaklah&lt;br /&gt;melakukan suatu siasatan struktur sepenuhnya yang&lt;br /&gt;hendaklah termasuk yang berikut:&lt;br /&gt;(i) mengambil semua langkah yang munasabah bagi&lt;br /&gt;memperoleh maklumat berhubungan dengan reka&lt;br /&gt;bentuk, pendirian, penyenggaraan dan sejarah&lt;br /&gt;bangunan itu;&lt;br /&gt;(ii) menyemak dengan usaha yang munasabah pelan&lt;br /&gt;struktur bangunan itu bersama dengan kiraan&lt;br /&gt;strukturnya, atau jika pelan atau kiraan itu tidak&lt;br /&gt;boleh didapati kena membina semula pelan dan&lt;br /&gt;kiraan itu jika dikehendaki sedemikian oleh pihak&lt;br /&gt;berkuasa tempatan, dengan tujuan untuk menentukan&lt;br /&gt;apa-apa kekurangan pada unsur struktur bangunan&lt;br /&gt;itu;&lt;br /&gt;(iii) &lt;span style="color: red;"&gt;melakukan ujian ke atas unsur struktur bangunan&lt;/span&gt;&lt;br /&gt;&lt;span style="color: red;"&gt;itu tanpa merosakkan mana-mana bahagiannya&lt;/span&gt;;&lt;br /&gt;(iv) melakukan ujian ke atas bahan binaan; dan&lt;br /&gt;(v) melakukan ujian beban ke atas mana-mana bahagian&lt;br /&gt;bangunan itu yang jurutera itu fikirkan perlu; dan&lt;br /&gt;(e) jurutera itu hendaklah selepas itu menyediakan dan&lt;br /&gt;mengemukakan kepada pihak berkuasa tempatan suatu&lt;br /&gt;laporan tentang siasatan struktur sepenuhnya itu dan&lt;br /&gt;syornya.&lt;br /&gt;(7) Seseorang jurutera yang melakukan suatu pemeriksaan atau&lt;br /&gt;siasatan struktur sepenuhnya ke atas sesuatu bangunan adalah berhak&lt;br /&gt;mendapat pada bila-bila masa yang munasabah akses penuh dan&lt;br /&gt;bebas ke bangunan itu dan mana-mana bahagiannya yang dia&lt;br /&gt;dikehendaki memeriksa atau menyiasat dan mana-mana orang yang&lt;br /&gt;menggalang, menghalang atau melengahkannya pada pelaksanaan&lt;br /&gt;tugasnya adalah melakukan suatu kesalahan.&lt;br /&gt;Jalan, Parit dan Bangunan 113&lt;br /&gt;(8) Tanpa menjejaskan hak pihak berkuasa tempatan untuk&lt;br /&gt;menjalankan kuasanya dan mendapatkan perbelanjaan di bawah&lt;br /&gt;seksyen ini, mana-mana pemunya sesuatu bangunan yang melangggar&lt;br /&gt;atau tidak mematuhi notis di bawah subseksyen (3) adalah melakukan&lt;br /&gt;suatu kesalahan.&lt;br /&gt;(9) Pihak Berkuasa Negeri boleh, melalui perintah dalam Warta,&lt;br /&gt;membuat peruntukan bagi pemakaian seksyen ini, dengan apa-apa&lt;br /&gt;penyesuaian atau ubahsuaian yang ditetapkan di dalamnya, bagi&lt;br /&gt;bangunan yang berkenaan dengannya tiada perakuan kelayakan&lt;br /&gt;menduduki dikeluarkan oleh pihak berkuasa tempatan.&lt;br /&gt;(10) Pihak berkuasa tempatan boleh, jika ia berpuas hati selepas&lt;br /&gt;menilai laporan pemeriksaan visual yang dikemukakan di bawah&lt;br /&gt;perenggan (6)(b) atau laporan siasatan struktur sepenuhnya dan&lt;br /&gt;syor jurutera yang dikemukakan di bawah perenggan (6)(e), mengikut&lt;br /&gt;mana-mana yang berkenaan—&lt;br /&gt;(a) bersetuju sepenuhnya dengannya;&lt;br /&gt;(b) menolaknya;&lt;br /&gt;(c) bersetuju dengan sebahagian daripadanya; atau&lt;br /&gt;(d) mendapatkan pandangan kedua ke atasnya.&lt;br /&gt;(11) Pihak berkuasa tempatan boleh selepas itu—&lt;br /&gt;(a) mengeluarkan suatu perintah kepada pemunya bangunan&lt;br /&gt;itu untuk mengambil langkah yang perlu untuk&lt;br /&gt;membetulkan atau membaiki apa-apa kecacatan, perubahan&lt;br /&gt;bentuk atau kemerosotan yang disyorkan oleh jurutera&lt;br /&gt;itu dalam apa-apa tempoh yang ditentukan oleh pihak&lt;br /&gt;berkuasa tempatan; atau&lt;br /&gt;(b) sebagai ganti kepada suatu penyiasatan di bawah seksyen&lt;br /&gt;83, mengeluarkan suatu perintah kepada pemunya bangunan&lt;br /&gt;itu bagi penutupan dan peruntuhannya.&lt;br /&gt;(12) Sebelum menjalankan kuasanya di bawah subseksyen (11),&lt;br /&gt;pihak berkuasa tempatan hendaklah, jika adalah semunasabahnya&lt;br /&gt;praktikal untuk berbuat sedemikian, menyampaikan suatu salinan&lt;br /&gt;perintah yang dibuat di bawahnya kepada tiap-tiap penduduk&lt;br /&gt;bangunan itu.&lt;br /&gt;114 Undang-Undang Malaysia AKTA 133&lt;br /&gt;(13) Mana-mana orang yang tidak mematuhi perintah yang&lt;br /&gt;diberikan di bawah subseksyen (11) boleh apabila disabitkan di&lt;br /&gt;denda tidak melebihi satu ratus ribu ringgit atau dipenjarakan bagi&lt;br /&gt;tempoh tidak melebihi lima tahun atau kedua-duanya dan juga&lt;br /&gt;boleh didenda tambahan tidak melebihi lima ratus ringgit bagi&lt;br /&gt;tiap-tiap hari kesalahan itu diteruskan selepas sabitan.&lt;br /&gt;(14) Walau apapun subseksyen (13) jika pemunya sesuatu&lt;br /&gt;bangunan tidak mematuhi suatu perintah yang dikeluarkan di bawah&lt;br /&gt;subseksyen (11), pihak berkuasa tempatan boleh mengambil apaapa&lt;br /&gt;langkah yang ditetapkan dalam perintah tersebut atau&lt;br /&gt;memperdapatkan penutupan dan peruntuhan bangunan itu dan&lt;br /&gt;mendapatkan daripada pemunyanya appointed for condominium building inspection may, at his discretion,to recommend non destructive test on the suspected damaged structures of the building.&lt;br /&gt;&lt;br /&gt;Structures needs further investigation are structures showed sign of deterioration such as:&lt;br /&gt;1.rusty steel reinforcement;&lt;br /&gt;2.damaged concrete&lt;br /&gt;3.moist concrete&lt;br /&gt;4.Others (if any)&lt;br /&gt;&lt;br /&gt;Non destructive structural testings will be carried out by specialist company appointed by the condo management.The cost of the test may range from few thousand ringgit to few hundred thousand ringgit.&lt;br /&gt;&lt;br /&gt;For simple case such as exposed rusty steel reinforcement and weak concrete cover, the engineer may&lt;br /&gt;request for "Rebound Hammer" test.Further tests such as "Ultra Sound ", "Moisture Content " and ect.ect.&lt;br /&gt;may be needed if the structure fail the rebound hammer test.&lt;br /&gt;&lt;br /&gt;Should the structure fail the /&gt;The local authorities' letter mentioned that visual observation to be conducted&lt;br /&gt;by a qualified civil and structural engineer.&lt;br /&gt;&lt;br /&gt;The word "visual" does no mean ,the structural engineer, just take a quick tour&lt;br /&gt;on the building and taking some photographs.&lt;br /&gt;&lt;br /&gt;The following is an excerpt of guideline of a local authority,which I think,&lt;br /&gt;may be useful for building management committee to conduct building&lt;br /&gt;inspection at their premises:&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="color: blue;"&gt;"There is a common misconception that a periodic structural inspection &lt;/span&gt;&lt;br /&gt;&lt;span style="color: blue;"&gt;involves only a “visual” record of the observations during a brief tour of the &lt;/span&gt;&lt;br /&gt;&lt;span style="color: blue;"&gt;building. Such misconception has to be corrected. The Building Control Act &lt;/span&gt;&lt;br /&gt;&lt;span style="color: blue;"&gt;requires the visual inspection to be conducted by a structural engineer who &lt;/span&gt;&lt;br /&gt;&lt;span style="color: blue;"&gt;must be a registered professional engineer in the civil or structural &lt;/span&gt;&lt;br /&gt;&lt;span style="color: blue;"&gt;engineering discipline, rather than any other person. It is so because of the &lt;/span&gt;&lt;br /&gt;&lt;span style="color: blue;"&gt;need for and importance of professional assessment and judgment in &lt;/span&gt;&lt;br /&gt;&lt;span style="color: blue;"&gt;structural engineering during the visual inspection. Any other lesser &lt;/span&gt;&lt;br /&gt;&lt;span style="color: blue;"&gt;assessment would provide little more than what a lay person could have &lt;/span&gt;&lt;br /&gt;&lt;span style="color: blue;"&gt;observed from a casual inspection. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="color: blue;"&gt;The structural engineer who is appointed by the building owner is therefore &lt;/span&gt;&lt;br /&gt;&lt;span style="color: blue;"&gt;expected to carry out a comprehensive visual inspection that relies largely on &lt;/span&gt;&lt;br /&gt;&lt;span style="color: blue;"&gt;his professional engineering assessment, judgment and advice. He shall &lt;/span&gt;&lt;br /&gt;&lt;span style="color: blue;"&gt;exercise reasonable diligence and take active and personal interest in the &lt;/span&gt;&lt;br /&gt;&lt;span style="color: blue;"&gt;planning and carrying out of the inspection of the building. color: blue;"&gt;"Prior to the commencement of visual inspection, the structural engineer is to &lt;/span&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;obtain a set of the building’s structural layout plans from the building owner. &lt;/span&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;The availability of the structural layout plan will help the structural engineer to: &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;(a) understand the structural system and layout of the building; &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;(b) identify critical areas for inspection; &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;(c) identify the allowable imposed loads, in order to assess the usage and &lt;/span&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;possibility of overloading; and &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;verify if unauthorised addition or alteration works that affect the structure &lt;/span&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;of the building have been carried out. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;In general, the structural engineer is expected to carry out, with reasonable &lt;/span&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;diligence, a visual inspection of: &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;the condition of the structure of the building &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;to identify the types of structural defects &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;to identify any signs of structural distress and deformation &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;to identify any signs of material deterioration &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;the loading on the structure of the building &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;to identify any change of use, misuse and abuse which can result in &lt;/span&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;overloading &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;any addition or alteration works affecting the structure of the building &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;to identify any addition or alteration works which can result in &lt;/span&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;overloading or adverse effects on the structure. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;If there are no signs of any structural deterioration or defects, the visual &lt;/span&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;inspection should suffice and unless the structural engineer otherwise &lt;/span&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;advises, no further action needs to be taken. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;If, on the other hand, signs of significant structural deterioration or defects are &lt;/span&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3; color: blue;"&gt;present, the structural engineer should make a professional assessment of &lt;/span&gt;&lt;br /&gt;&lt;span style="background-color: #f3f3f3;
